Climate Litigation in India

A recent ruling by India’s apex Supreme Court has held that the people have a right to be free from the adverse effects of climate change within the ambit of fundamental rights.

Climate justice is a relatively new aspect in Indian courts. While the National Green Tribunal is often approached when there are ‘developmental’ projects that threaten ecology, there has not really been a concerted effort or awareness drive as far as climate justice is concerned.

However, recently the Supreme Court of India, the foremost authority on all things law and justice has ruled that people have a fundamental right to be protected against the impact of climate change.

What that means may be something that we will take time to understand, process and implement but it is still a step in the right direction.
